1. About these terms

These Terms and Conditions ("Terms") govern the relationship between Daily Leads ABN 82 645 903 055 ("Daily Leads", "we", "us") and any person or business ("Client", "you") who engages our lead generation services.

By signing up, completing our onboarding form, or making payment to Daily Leads, you agree to be bound by these Terms. Please read them carefully.

These Terms are governed by the laws of Queensland, Australia.


2. Our service

Daily Leads provides a pay-per-lead service whereby we:

Create and manage targeted advertising campaigns on platforms including Facebook and Instagram on behalf of trade business clients

Capture enquiries from homeowners and consumers seeking quotes for home improvement services including patios, carports and decks

Deliver those enquiries ("Leads") to registered Clients whose service area matches the consumer's location

Invoice Clients for each Lead delivered at the agreed rate.

We do not guarantee that any Lead will result in a booked job, a completed sale or any particular revenue outcome. We provide enquiries from interested consumers, the outcome of those enquiries depends on the Client's own sales process, pricing and follow-up.


3. Lead exclusivity

Each Lead is delivered exclusively to one Client per trade per service area. We do not sell or distribute the same Lead to multiple Clients.

Service areas are allocated on a first-come, first-served basis. Once a suburb is allocated to a Client for a particular trade, no other Client in that trade will receive Leads from that suburb while the original Client's account remains active.

Daily Leads reserves the right to adjust service area boundaries where necessary due to geographic demand, Client changes or other operational requirements. We will notify you of any material changes to your allocated service area.


4. Lead delivery

Leads are delivered to the email address and/or mobile number nominated by the Client during onboarding.

It is the Client's responsibility to ensure that their nominated contact details are current and correct. Daily Leads is not liable for Leads that are undelivered due to incorrect contact details provided by the Client.

Lead delivery times may vary. While most campaigns produce Leads within 24–72 hours of launch, we do not guarantee a specific volume or frequency of Lead delivery. Lead flow is subject to advertising platform performance, market demand and seasonal factors.


5. Pricing and payment

The price per Lead is agreed between Daily Leads and the Client prior to campaign launch and confirmed in writing.

Invoices are issued per Lead delivered and are due within 7 days of the invoice date unless otherwise agreed in writing.

Overdue invoices may result in suspension of Lead delivery until the outstanding balance is paid. Daily Leads reserves the right to charge interest on overdue amounts at a rate of 10% per annum, calculated daily.

Prices may be reviewed by Daily Leads with 14 days written notice to the Client.


6. Lead credits and refund policy

We are committed to delivering quality Leads. A credit will be issued for a Lead that meets any of the following criteria:

The phone number provided is invalid or disconnected

The Lead is a duplicate of one already delivered to you in the same 30-day period

The Lead falls outside your agreed service area

The Lead was clearly submitted as a test or spam entry

Credits will not be issued for Leads where:

The consumer did not respond to your follow-up attempts

The consumer changed their mind or decided not to proceed

The Lead did not convert to a quote or a job

You were unable to contact the Lead after a single attempt

To request a credit, you must notify us in writing within 48 hours of the Lead being delivered, providing the Lead's name, delivery time and the reason for the credit request. Credits are applied to your account and offset against future Lead invoices.

We do not issue cash refunds.


7. Client obligations

As a Client of Daily Leads, you agree to:

Provide accurate information during onboarding and notify us promptly of any changes to your service area, contact details or trade offering

Follow up all delivered Leads promptly, we strongly recommend contact within one hour of delivery

Maintain a professional and lawful standard of conduct when contacting consumers

Hold all relevant licences, registrations and insurances required to operate your trade business in your state or territory

Not use Leads for any purpose other than providing the service the consumer enquired about

Not share, sell or transfer Leads to any third party

You acknowledge that Daily Leads acts as a lead generation intermediary only and is not a party to any agreement between you and the consumer.


8. Advertising and campaigns

Daily Leads manages advertising campaigns on your behalf using platforms including Facebook and Instagram, Google or TikTok. You grant us permission to:

Create and publish advertisements referencing your trade, service area and general business type

Use any photos, logos or branding materials you provide for use in advertising

Make reasonable creative and targeting decisions to optimise campaign performance

You warrant that any materials you provide to us (including photos and logos) are owned by you or that you have the right to use them, and that their use in advertising will not infringe any third-party rights.

Daily Leads does not guarantee specific advertising outcomes including impressions, clicks, reach or Lead volume. Advertising performance is subject to platform algorithms, market conditions and audience demand.


9. Intellectual property

All advertising creative, campaign strategies, copy and materials developed by Daily Leads remain the intellectual property of Daily Leads unless otherwise agreed in writing.

Any photos, logos and branding materials provided by you remain your property. You grant Daily Leads a non-exclusive licence to use these materials for the purpose of creating and running your advertising campaigns.


10. Confidentiality

Both parties agree to keep confidential any information shared in the course of the business relationship that is not publicly available, including Lead data, campaign performance data, pricing and business information.

Consumer personal information (Lead data) must be handled by the Client in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You must not use consumer information for any purpose other than responding to their enquiry.


11. Pausing and cancellation

You may request to pause Lead delivery at any time with no penalty. Pauses can be requested by contacting us by phone or email. Leads already in delivery at the time of a pause request will still be invoiced.

Either party may terminate the arrangement at any time with 30 days written notice. There are no lock-in contracts or cancellation fees.

Upon termination:

All outstanding invoices become immediately payable

Your service area allocation will be released and may be offered to another Client

Lead delivery will cease at the end of the notice period


12. Limitation of liability

To the maximum extent permitted by law, Daily Leads' total liability to you for any claim arising out of or in connection with these Terms or our services is limited to the total amount paid by you to Daily Leads in the 30 days preceding the claim.

Daily Leads is not liable for:

Any indirect, consequential, special or incidental loss or damage

Loss of revenue, profit, opportunity or business arising from Lead delivery or non-delivery

The conduct, actions or omissions of consumers whose details are delivered as Leads

Any failure or delay caused by circumstances outside our reasonable control including platform outages, changes to advertising platform policies or force majeure events.

Nothing in these Terms excludes, restricts or modifies any right or guarantee that cannot be excluded under the Australian Consumer Law.


13. Disputes

If a dispute arises between us, both parties agree to first attempt to resolve it in good faith through direct negotiation.

If the dispute cannot be resolved within 14 days of written notice, either party may refer the matter to mediation through a mutually agreed mediator before commencing legal proceedings.

These Terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland.


14. Changes to these terms

Daily Leads reserves the right to update these Terms at any time. We will notify active Clients of any material changes with at least 14 days written notice via email. Continued use of our services after that date constitutes acceptance of the updated Terms.
